CAPE MAY---An Article 32 Investigation for Petty Officer 1st Class Wilson Medina who is charged with violating two punitive Articles of the Uniform Code of Military Justice, appeared Thursday at a preliminary hearing. Held at the Coast Guard Training Center, Medina is accused of one count of abusive sexual contact and one count of forcible sodomy.
In order to protect the privacy of the 23-year old victim, who also works at the Cape May base, media cameras were not allowed in during the hearing.
The victim said what started out as respect for Medina, a recruit company commander in the Coast Guard, ended as a nightmare.
While on the stand and under oath, the victim said Thursday, that on November 10, 2007 following a night of drinking alcohol and watching boxing, his former commander allegedly touched his genitals. The victim claims he told Medina to stop and went into another room to sleep. But then, the victim said he awoke to Medina on top of him, performing oral sex.
"There is certainly more than one side of this story," Said Dale Saran, Medina’s attorney, "We're just hoping to get a fair hearing and bring out some of the issues that we think are important." He said.
Meanwhile, Veronica Bandrowsky, the Public Affairs Officer for the U.S.C.G explained, "A preliminary hearing is held to gather information by the investigating officer, it's important to note that all members are innocent until or unless proven guilty."
The investigating officer will review the evidence and write a report to the convening authority. And according to Medina's attorney, to help the process, he says his client is even paying for Thursday's hearing to be tape-recorded, "So that there's no question about who said what when." Says Saran.
Officials say the investigating officer will write his report in the coming weeks and the findings should be released in about a month.
Meanwhile, Medina who was part of the training division staff and served as a recruit company commander has since been reassigned to new duties and has no contact with recruits.
